been a member here a while, and always had good experiences with buying/selling art, but now I've gotten in a situation where a forum member is trying to scam me through paypal.
To sum up the case Forum member XXX agreed to buy a framed "Dolk - Kitty Riot (green) print" from me. The buyer wanted me to place a low price on the package (GBP 100) inc. to write gift to avoid paying taxes to the customs in his country. I agreed to this, but then he had to take full responsibility for possible damages during transportation. Because both him and me knew that FedEx only will refund the value placed on the package I wanted him to agree to this in case FedEx managed to damage the package (you never know).
I have evidence of him confirming this from both this forum and through e-mail:
The package arrived damaged even though it was very well packed with several layers of bubble plastic, cartboard etc., the glass was broken and the print had a small scratch in the paper (not at the actual motive).
To be kind I offered him that we could split the bill to have a paper conservator fix the print, and a framer put in a new glass. He did not answer to this, and now he is deliberately trying to scam me and get a full refound through Paypal (including the 340 GBP I paid in shipping myself).
If I had written full value on the package, FedEx would have covered the damaged print and there would be no case between us. I have disagreed with the claim through Paypal, but does anyone know what else I can do? I do not want to end up with refunding the entire sum, the shipping costs, the cut paypal took including leaving me with the damaged artwork.
I appreciate all help from sellers who have been in a similar situation before.

The forum member, Tao, scammed me and paypal helped him. I waited to go public with his name, because I hoped the situation would be resolved. I've now received the print, and I will take it to the paper restorer at the Edvard Munch Museum and have it fixed, but it will cost me $$$ to make it mint again. I also must cover the shipping costs and the paypal fees.
I would therefore recommend nobody to make deals with the forum member "Tao".
Tao's name is Masumi Ogai and he runs a gallery in Nagoya, Japan called Rat King - rat-king.com/

It's your fault for agreeing to ship a print in a frame without crating it and you should have known that if someone wants to pay and accept responsibility for loss or damage they must pay via a method from which they have no automatic course to obtain a refund. Live and learn and be happy that this was a transaction for a small amount.

Also if the shipper knows it was art not to mention framed with glass, they probably wouldnt cover you whatever you had done. Their insurances normally exclude both.

From my understanding, no they won't. You failed to deliver goods as described to buyer. You lose. Paypal does not care about insurance and whatnot. Any email agreement, especially on a third party system, does not absolve you of the responsibility of following Paypal's rules.
The buyer may not be operating straight up here, but it was your shipping failure and your lack of protecting yourself with maximal insurance that has you in the situation you are in.

I think your offer to pay towards repairs was a fair one, so perhaps try and "reason" with the guy again so you do not lose everything.
Even if an item is fully insured the delivery companies do there best not to pay out. Many will not pay claims where glass and or art is involved (despite what many think) Best way to protect yourself is to "over pack" the item, but still not fool proof, even crates can get smashed!

Plus, I think you can ask for the damaged item to be returned in it's current condition before a full refund (if you have to go that way)... at least that way you don't lose completely and can repair it.
In either case, tell the buyer you'll expose them here for this type of behaviour.

My personal recommendation is to ship rolled whenever you can. Flat shipping, from my experience, has a much higher damage rate. Rolled in a Yazoo Mills tube(tube producer that is local to me) = indestructible. Or go to your local mega hardware store, get a big-diameter PVC pipe cut to length and buy end caps. Roll print in glassine, or white kraft paper, insert, and you are also indestructible.

You have to stop thinking of it as a good deed. The buyer asked you to commit fraud. YOU actually committed fraud.

You have to stop thinking of it as a good deed. The buyer asked you to commit fraud. YOU actually committed fraud.

For FedEx what I have found - but not yet tried - is that if THEY package the item in their FedEx Office location then the insurance can be increased to full value. however, the cost of their packaging and cost of the insurance would surely give you pause on a < $500 item. obviously if you are shipping a $5000 item you have a lot more leeway and responsibility in the packaging. sorry about your bad experience and this is a good reminder for all sellers that you are in control .. not the buyer.. if you agree to the buyers terms .. you are really at a disadvantage.

I would have taken the print out and shipped it flat between many layers of cardboard and plastic and the backside of the frame. The buyer agreed to accept liability for damages so they should accept liability due to the written contract, but the print also should have been packed better.

Still, I offered splitting the bill on the paper conservator and new glass to be nice, as I also felt bad for the buyer. It's then I feel it's not a gentleman-move to claim everything back including shipping etc.
I feel sorry for the buyer....... I can see that the seller is an honest person, that you mean well, but so is the buyer, they have ended up with a damaged print! 1. Never accept Paypal gift 2. Never post in glassed frame 3. Do everything by the book so you yourself are covered I feel for you, but the person to blame is, unfortunately, yourself! You can give all the evidence to Paypal and hope they come out on your side... include the emails where you agree to a settlement/helping to repair it. Plus, I think you can ask for the damaged item to be returned in it's current condition before a full refund (if you have to go that way)... at least that way you don't lose completely and can repair it. In either case, tell the buyer you'll expose them here for this type of behaviour. Thanks, hopefully he will return the item in the same condition, and I will have it fixed at a paper conservator.

Like in the Paddle 8 issues thread, I think a lot of us assume certain things about how these businesses work and what our liability is. Assumptions are often very wrong, to our detriment.
