if they are limited company you are done for i think and you have to contact the receivers and hope to get your goods/fees ..........but i may be wrong .

Case may be strong, but sue for what? You can't get blood from a stone. James sniffed all the cash up and still collectively owes artists over £100k at last count so chances of anyone getting anything out of him is slim. On the positive... he likely owes dealers cash too, and their justice will far outstrip the negative effect any civil suit could cause him.

The Leonard Street Gallery, by Heavyconsumer on Jul 12, 2008 4:41:00 GMT 1, People like that tend to make sure their dealer is paid up, at the expense of other duties, hence this mess no doubt, if there is truth to the drug related rumour.
I feel terrible for his staff, who whenever I've called with a query, have been very helpful, friendly and professional. And I feel awful for those of you who have paid for art that hasn't been received. I hope that somehow the gallery manages to fulfill the outstanding orders. I mean what else can they do with art that has been sold? (Excuse me if that's a naive question, but I'm not in either art-dealing or law and it seems to me that once you've paid, you own it!?!?)

The Leonard Street Gallery, by craigf on Jul 12, 2008 7:53:57 GMT 1, If you pay for something that you haven't recieved you become an unsecured creditor rather than the owner of the piece. The piece remains in the ownership of the company unless it was on consignment then the artist still owns it. In this case I think there is going to be a right mess with neither the artist getting their piece back or the buyer getting it to put on the wall

HPS - i'm sure James didn't mean to rip anyone off, but the fact is that as far as the rumour mill is concerned, they have mismanaged funds and used them unwisely for their own purposes.
Maybe we should tell some of the people that are seriously out of pocket that James didn't mean to rip them off, see if that makes them feel better. I somehow doubt it.

This is very wise advice. If anybody has a receipt for the goods then get in touch with the receiver straight away. TLSG are simply in possesion of something you already own.

I'm sure someone said they're not (well they weren't) a limited company

If they do not have Limited liability then you can make a private claim against the owners but that will be less fruitful I would guess as they will have to declare themselves bankrupt. Has anbody checked with companies house?

By the way Comanies House shows David Gray resigned a while back.

The Leonard Street Gallery, by scavos on Jul 13, 2008 23:41:36 GMT 1, Gary, that f**king sucks. Really sorry to hear about that mate. I thought my loss was bad. Glad to hear at least you have the skulls and might be able to help some people out who bought them. Don't suppose you have the Believing Standard prints too do you? I'm especially gutted because I had one of the framed #1's and another unframed; I was going to collect them the next time I was in London. If I'd have said I didn't want the frame I would have possibly have had them through the post shortly after the end of the show. To hear you lost that much makes me realise how big a deal this whole situation is. There must be hundreds of thousands of £££ owing. What has happened to all that artwork they must have there? I presume it will be the responsibility of the receivers. I wonder what they will eventually do with it all. If it has to be sold to cover losses than how? Any ideas?

really hope people who've come off badly find some sort of solution, this does nothing whatsoever for the industry / buyer confidence and all that.

The Leonard Street Gallery, by Partyfoodprincess on Jul 25, 2008 19:47:51 GMT 1, Just checked the website...now it makes sense why they are not returning calls/emails....
I'm owed ££££ from TLSG in respect of a gold beejoir...owed now for about 2 months.
Unfortunately, as a mere unsecured creditor the chances of getting over 10% of what you are owed are slim...even collectively chances of scraping back any owed monies are zilch.
Any names/numbers to try and claw back some ££££ gratefully received.
Shame its shut down.
Does anyone have the official name by which the company is registered or a company number? Might be an idea to check companies house to see if its actually in liquidation or not?
