Damaged print - advice needed!, by mickg on Jun 12, 2007 18:59:11 GMT 1, I've just received a print (described as mint) that I bought through ebay / paypal from an experienced seller. It arrived badly damaged with no visible damage to the very strong tube it came in. It wasn't sent by insured post. The seller is insisting I contact Royal Mail to make a claim as he swears it was sent in perfect condition. Does anyone have any experience of this? Who is responsible for the print during transit? The damage is along the edge by a corner at the end of the rolled poster but I think it is too severe to have been caused by rough handling of the tube. Thanks!

Also this could be a trick to complicate matters for when paypal have to decide upon the dispute. Take some pics of the dammaged print just in case paypal or the credit card company ask for evidence. If you've paid by credit card apparently you're better off claiming from them otherwise take it up with paypal but don't leave it too late, you only have around 20 days to open a dispute. Other forum members are very experienced on this matter and you will no doubt recieve a lot of help regarding this. It might take six weeks or so to resolve.

If he isnt a business, then you could still get your money back by compaining to him, but he is clearly trying to rip you off. Also the seller probably isnt a business so it is your obligation to state that insurance is needed, least you know for next time.

I think paypal will usually side with the buyer all things being equal (I would). I'm awaiting a reponse on exactly this issue and should hear from paypal anyday now. I'll keep you all informed.

I tell you what though, I got one of my mode2's direct from POW and the corner was creased...what would you do there? I didn't worry too much as it was an unsigned for a friend...but now I'm thinking I should mail them...

I take extra care when sending my prints out and in this particular case sent the print out in an oversize tube approx 7 or 8 inch diameter and wrapped it carefully in acid free tissue paper. I sent it in this tube so as it would have more than adequate space. I also sent it insured post and not as stated un=insured. Furthermore I sent the print out about a week before I had cleared funds in my account. If (and I would not) I had sent it out damaged then the least I would have done is to have waited to have cleared funds in my account for obvious reasons.
Where do we go from here?

It makes me think the next time I'm sending or recieving a print of any serious value I'm doing it with the web cam recording the whole damn thing. Maybe thats the future.

His story sounds very unconvincing, particularly as you say the tube is in good condition with no dings. Agree with the other forum members posts. His responsibility. You are due a full refund and you weren't born yesterday!
