Brandalised • Full Colour Black, by Easy-Z on Oct 6, 2019 23:15:20 GMT 1, Full Colour Black (https://fullcolourblack.com) as we all know is the postcard company at the supposed root of Banksy starting the GDP (https://grossdomesticproduct.com/).
I figured it would be good to have a separate post for discussing this, to not get buried in the GDP thread. But it just doesn't add up (as does little often in the smoke and mirrors of Banksy).
FCB states Banksy's claims to be untrue: www.facebook.com/notes/full-colour-black/public-statement-release/2557627524344258/
Though it is a refusal at the claims, it seems to be a harsh lash out towards someone who's coat tails they are riding.
Furthermore, they seem to be an awfully small company for Banksy to go after. Especially when there are so many Pranksy's out there. Certainly WCP, Not Banksy, Not not Banksy, The Real Not Banksy, and Mrs. Banksy are cashing in the same or more that a postcard company. Are some of those members of team Banksy and secretly given the ok? Is FCB on the ok list and brought into this for hype all the way around? Or is there more?
I decided to reach out to FCB directly myself. Amazing quick reply time considering the level of hate mail and orders they must be getting. So far a pretty civil conversation.
Of course there is the debate of should a company use the imagery of an artist, and what is and not considered public domain. We can discuss that here as well.
Let's share here what we find out in the coming days.

Brandalised • Full Colour Black, by jp on Oct 6, 2019 23:28:46 GMT 1, The use of imagery is not the issue. The card company has been doing that for a long time now. It's this, as was posted by @manty100
"Aaron Wood, a lawyer from Keystone Law representing Full Colour Black, confirmed the greetings card company had made an application for a declaration of invalidity against a Banksy EU trademark."
That means they are trying to take Banksy's trademark right from under the artist, so they can make what they want with impunity, and license banksy products to other companies (and they are already doing this I believe with the Japanese company Medicom). *That* is the real issue here.

And if they truly are trying to trade make his name, then of course it is beyond ridiculous. However, why not quietly go after them? Announcing this being the purpose of GDP has only made the postcard company a household name amongst Banksy fans..... Which in turn, like it or not will boost their sales.

They own Brandilised, which has been selling Banksy images to various companies for quite a long time (Mighty Jaxx for figures, Eleven Paris for shirts, etc.). I have seen the Eleven Paris shirts at Saks 5th Ave factory outlet store..... And wondered about how any company gets away with such a clear use of others work.
it is all ironic with how much Banksy has taken from Blek and recycled themes. But street art is not the same as resale of someone else work.

Not proof per se, but suggestive evidence of an official connection, be it license or tacit approval. With Banksy merch (other than prints), that seems to be as 'official' as it gets."
Wow. These are some cheeky feckers.

He has apparently been advised that the best way to defend his trademark is to use it. That means producing and selling goods under it - so a shop of some description is a necessity.
I haven’t seen GDP go after anyone specific. They’ve mentioned no names to my knowledge - it’s the media who has done that, and FCB seem to have jumped in with a refutation of Banksy’s claims even though Banksy, again to the best of my knowledge, has made no claims specifically about FCB. Everything I’ve seen has just referred to a greetings card company.

Banksy is counting on the fact that Tony the Tiger would never show up to court in person to defend himself.
This board is right mental.

Wasnt GDP for trademark purposes... I’m guessing Banksy isn’t announcing his collaboration with them but seems like he’s allowing his images to be sold with medicom items.

I still don’t get Brandalism... is it or is it not Banksy side company allowing other companies to use his images. It seems like he’s not complaining about a big company like medicom using his images to sell items. I’m guessing they are paying Banksy something to use his work.

Full Colour Black is suing Banksy to try and steal his trademark.
Full Colour Black issued unauthorized licenses to Medicom.
It's likely, as part of those licenses, Full Colour Black have asserted they have legal rights to the images they license and assume full legal responsibility.
Full Colour Black are a bunch of complete and total dirtbags.
This is also why we can't have nice things.

Do they make copy’s of these in China like fake KAWS? Are the real ones or fake ones worth anything? Worth collecting?

Although I think claiming the image is a "logo" is what Banksy is trying to do with GDP to stop this type of thing.

I believe this is the first time they are not claiming that these are a collaboration with Banksy, or Brandalism, but actually with the company that Banksy & co sued a while back for stealing his images.
I am not sure, but I believe this is the first time Medicom is stating that these were done with Full Color Black, the official banksy copycats.
TO BE CLEAR THIS IS HIJACKED, COURT SANCTIONED THEFT OF BANKSY'S INTELLECTUAL PROPERTY.

Happily when they made these moulds they did them in China. And China doesn't protect IP so if you want one, and they are cool looking IMO, head on over to etsy and for a couple hundred pounds you can get a great knock off. And a knock off of stolen IP seems very "Banksy" to me. I have LIITA and Balloons Girl as knock offs of stolen designs.
