I may be wrong but I think it's just a simple raffle, therefore you are just paying to be in with a chance of winning the print. The winner of this raffle will not have any further costs to bear except postage.

Art On A Postcard, by mutatis on Jul 17, 2017 16:39:08 GMT 1, I've never known people wanting to break the balls of a charity before, only on UAA eh? Makes me wonder why certain people are obsessing about the Law, to be honest comes across as very bitter. As long as they have good intent, they are fine and haven't knowingly broken the law, thats how a judge would see it. I say good day to you Sir. Not knowing the law, is a pretty weak defence. I'm sure the vast majority of charities if not all try to do their best, but let's not be naive charities can't just be given a free ride to do what they want. That's just not how it works. Years ago, I supported a local organisation to get charitable status so I know a bit about this area. It's an unbelievably arduous process and one that involves sticking to a defined code of conduct and very clear rules on fund raising and accountability. If this wasn't in place anyone could just call themselves a charity. I was pretty surprised that this charity has on occasions taken quite confrontational stance with their prospective patrons and I saw this first hand at the Boot Sale. I guess they're entitled to do that, but in my opinion it reflected poorly on them. I don't see your post as breaking the balls of the charity. It seems that critical observation is discouraged around here and prevents people from posting. Just as ignorantia juris non excusat (ignorance of the law is no excuse) is a fundamental legal principle equally ignorantia iuris nocet (ignorance of the law is harmful). Of interest reading the threads across the forum is the selective invocation of legality and suggestions that legality is anathema to urban art.
Whilst gambling and the Gambling Act 2005 is not my area of expertise, I have enough experience of prize draws, competitions and lotteries. You are right, this field to the unsuspecting, is riddled with complexities and is heavily regulated, for the reason you state and protection of the public. More often than not breaches of the law are unintentional. I would very much trust though that AOAP given their charitable status and the nature of their fundraising activities for the Hepatitis C Trust, have done what is legally required to run this lottery. After all it is not the WI tombola at the local village hall, which are the type of events that often get overlooked, but equally have been known to fall foul of the law. Depending on the financial status of AOAP, a gaming licence may not be needed as opposed to registering with the local licensing authority.
What is legally of interest to my mind, is the fact that they are "giving away" 10 free tickets. If lottery tickets are sold, they should be sold at the same price, for obvious reasons. One can make one's own logical extrapolations from this scenario.
Nothing written above stops me from wishing AOAP well, having donated directly to them and the Hepatitis C Trust in the past. I might just do the same again as it's a very important cause.
Good luck to all those who entered.
