Banksy monkey parliament FS, by gibbin82 on Aug 18, 2011 12:22:45 GMT 1, It is nice to report when a deal goes right and everyone is happy and equally I suppose it is important to warn people when things do not go so smoothly. In this case I was the unlucky person to actually end up buying this poster and as it arrived quite badly damaged I contacted the seller but have no luck getting a refund, so giving him plenty of time to put things right this is now going to have to go to the small claims court to make a judgment. So beware of buying from this member, it has not been the usually pleasant experience I have encountered from all of my other dealings with other members on the forum .

Banksy monkey parliament FS, by chaturz on Aug 18, 2011 13:18:14 GMT 1, Wow, that's rubbish. Was it damaged in the post or did you collect in person and realise damage at home? Hope things work out ok and amicably if possible + let us know how it pans out as it would be interesting to know how to handle such a predicament, I've been rather fortunate so far. Good luck

Calm down son! I doubt you are far enough down the line for court action just yet given it is less then a month since you even bought the print! A court will require that you try and negotiate a settlement first which will ordinarily include giving a minimum period of one month for a party to respond to an initial claim.
In any event you don't get to choose to go to the small claims court this is decided during allocation. If you want to make him realise you are serious I would send him a completed claim form stating that it will be lodged if you don't get your money back. Fee for lodging is £35 though so I'd ask yourself is it really worth it!

Banksy monkey parliament FS, by gibbin82 on Aug 18, 2011 13:38:45 GMT 1, It appeared as though the damage had been caused by the end cap being pushed in against the poster, although at first I gave him the benefit of doubt and agreed that it could have been caused by the royal mail and in such case he could have claimed compensation from them.
Although I have tried to negotiate amicable solution IMO it was pretty clear from some of the response that this would not be possible and therefore after giving him to plenty of opportunity to resolve it I finally decided a small claim was the way forward. The cost was £25 and to be honest it is well worth it to stop the "I have spoken to trading standards and it is Buyer Beware" type replies and general annoying delaying tactics in hope I will forget it. He also wanted me to return it at my own expense before any refund was considered, but given some of his replies I would rather keep the evidence until a judge decides on when it is returned.

I sold a poster a while ago i think for approx 50 pounds, when i sent it it was mint and seemed to get damaged on route or when placed in the tube which i was really sure i was carefull with, it was very minor damage and i thought it could have been that it was damged removing it from the tube, Basically either way it was damaged and they buyer seemd like a nice guy and we decided on a part refund as ithe damage could easily be framed out,. WCould this have not been an option rather than claims, ? just a suggestion but from what i gather you have already started the claim?

Banksy monkey parliament FS, by gibbin82 on Aug 18, 2011 14:13:08 GMT 1, Framing the damage out was something I also originally thought of, suggested and I would have been happy to compromise, but after waiting for a fortnight for a reply and the hostile response I received when I suggested that it appeared as though I was being ignored and it possibly would have to be decided in the small claims court if it couldn't be resolved, I did not feel so easy going and agreeable. I have now had several excuses and the suggestion that it is a "Buyer Beware" transaction leaves me with the belief that the seller does not intend to compensate me at all.

Obviously I can only go on my experience and am not casting judgement or opinion on anyone else!

Banksy monkey parliament FS, by gibbin82 on Aug 18, 2011 20:44:26 GMT 1, £50 inc. P&P for a Monkey Parliament which arrived damaged so now you're taking the seller to court? LOL. How did you pay for it?
Unfortunately the damage IMO was not minor and it was paid for by Paypal gift so no chance to recover my money there.
At the time (although it was only £50 to me it is not small change) the way the dialog was going a small claim was the only option, I had been trying to seek a compromise from the start, firstly by saying I may be able to frame the damage out and at that stage may have been open to some sort of partial compensation via a claim from the Royal Mail, then by asking for the sellers address so I could send back the poster and receive a refund after he had it back. But as the affair ran on and with each delay or reply I felt forced into taking a more hard line, until and after plenty of warning I took the option of starting a small claim (a Buyer Beware comment was the final straw). As it was I never wanted to escalate this to a claim and this could and should have been avoided with a little more understanding and trust. However I have had a couple of incidents in the past when a claim was the only solution (once with and eBay purchase and once with a insurance claim from Parcel2Go) and to be honest this deal had seemed to be starting to be following an all to familiar pattern.
When deals go wrong it is important both parties are reasonable and do their best to resolve it quickly and amicably, but when this doesn't happen sometimes a PayPal claim (when it isn't a gift payment) or an online small claim may be the best option on principal.
The good news is that the seller is now IMO being a lot more reasonable and made a partial refund, so after a little negotiation we should be able to resolve this and I will be able to cancel the claim.

Banksy monkey parliament FS, by gibbin82 on Aug 18, 2011 21:05:20 GMT 1, Update: reasonable dialog now resumed and compromise reached, so the claim will be canceled and all a little older, wiser poorer and happier (well maybe not as happy as we should have been ;D).
Thank you to the seller for finally sorting this out, no hard feelings on my part, just put it down to experience
Anyone who hasn't heard of the UK Government Money Claim Online service it can be a good way of resolving disputes fairly when there appears to be no other solution, Paypal gifters take note.

Banksy monkey parliament FS, by kaisersosay on Aug 18, 2011 21:09:36 GMT 1, I bought one from a forum member for £40 including postage, a couple of small dinks you cant really see. I also bought another from eBay which came from Holland for £56 including postage mint. At the end of the day it's a poster to fill some wall space, not a £4,000 signed Banksy print. I can't stand paypal but if your buying it's a must, if selling I would rather poke my eye out with a sharp stick.
