Round up the posse, Im Feeling ripped off! , by rabbitlegs on Jun 8, 2007 13:01:11 GMT 1, I recently purchased a signed Banksy screenprint off eBay, A bit of an impulsive decision as the auction only had a few min's left when I saw it. I bid at last min and won.
At the moment I dont want to name and shame but his feedback was good (sold a few other prints before)
Anyway due to the high value I asked if I could pick up on collection....'NO', was the answer 'Im going abroad this week' my friend will post when money cleared.
mmm... So I pay several thousand into his account, email and ask if he would send the gallery provenance,as pictured in advert. In a seperate envelope for security (This was the main reason for paying a little bit more. Full gallery Prov. )
So I wait for a week.. (suppose to be parcel force 48hr delivery) Email him. He says sorry parcel force have messed up wont be delivered till next week now Im starting to worry!
Anyway best part of a week goes by and Posty turns up with tube, Print is inside and all is good I breath a hugh sigh of relief and wait for receipt.
Im still waiting, its been over a month now and no reply to any emails..
What bugs me is its now no use to him as it states the print name and number?
Do I have a cat in hells chance of a refund or getting my receipt ( personally I dont think so. Just glad he sent the print ) But all I have now is a photograph of the receipt and the eBay print offs
Never got the blokes address, Just his full name, bank details and ebay account (with matching name).
Should I try and forget about it,or is there anything I can do?

This assumes the seller mentioned the provenance as part of the sale which it sounds like they did as they included a photo.

If the provenance was something that was supposed to come with the item then you have not, in my opinion, received the entire item. Open up both an ebay and paypal claim and try for a full refund. Maybe you will get your cash back and keep the print. You could try and argue that the print is worthless without the provenance thus it is an integral piece of the item purchased (and was advertised when you bought it). My $0.02.

Otherwise the option you have to shit him up a bit is .......
go back to the auction page and near the top left there is this option
To report that this item hasn't been received, you can report the item as not received.
- select that and you can then go through the steps to select ... The item I received is significantly different from the item description.
You then select the payment method you've used and once done you have opened a dispute upon which the seller must respond.

For all it's benefits, this is one side of the bay that drives me mad...I know it's not what eBay set up to do and it would be a nightmare to administer, but I reckon they should set up a more comprehensive database for sales & purchases over a set value. My mate bought a car of eBay, and fair enough he should've checked it thoroughly but the guy seemed to have all the docs in hand, 7 months on, it turns out to be a ringer.

He sent me the prints - all were creased right down the middle + no provenance as promised. The tube he used also had no name or return address hmmmm. He said there was nothing he can do as "thats how he received them". Blah blah blah after a few more emails I filed a dispute. He changed his tune during the dispute process and eventually was forced by paypal to reveal his name and address so I can return the prints. Got my refund a month or so after I opened the dispute. The important thing is when buying stuff on the bay make sure the seller has adequate buyer protection - in the states its up to $2000 usd.

if he's paid using a credit card forget claiming through paypal and go straight to the card provider and explain the print was bought together with its original sales reciept but the seller has not provided the original sales receipt when sending the goods.
The item is not as described & therefore not fit for purpose. There is every chance that the card company will reverse the payment on paypal so paypal will have to reverse the payment to the seller. If card provider resist to begin with continue toi apply pressure stating the reciept is the provenance/guarantee of the prints integrity.
...nothing ventured and all that.

i think police is spot on, mike is a legend and i can see a happy ending on this one. hopefully just a lazy seller who can't be arsed.
p.s if anyone has other serious concerns about the legitimacy of a print, feeling they've been ripped off or any serious problem to do with ebay, police aware is your man. he's a bit like the a-team, if you can find him and he can help, maybe you could hire.....etc. if you don't know his general whereabouts, just post a thread asking where to look and i'm sure someone will PM you sharpish.

Im not 100% sure but once you've transfered the money from your paypal account, they can't do owt until you get some more funds in the paypal account. Before my unsaviouary incident I used to enjoy having a little "float" in my paypal account, now I empty asap!

It always puzzles me that when we buy things on ebay we expect them to arrive the next day yet when we buy things any other way we are happy to wait. I've been waiting 3 1/2 months for my Eine monster from POW and have had numerous broken promises from Dora about when it is likely to be delivered.

I do not disagree with you, but I think the fact you know there is an actual brick and mortar location that you could go to if you felt ripped off is easier on the patience than sending payment to someone on the bay. We have all heard so many horror stories about cons and such, it is hard to be easy with a purchase from sellers on there.
By the way... this is coming from someone very keen on instant gratification!
