so I contact the guy and ask him to take it down from the site. or i will take the appropriate action against him. (in this exact words)

and he replyes:

Most of Shepherd Faireys work is an exact replica of propaganda posters and other images.Andy Warhol never was sued by the Campbell soup company,Why, because he had artist license to replicate the image. I looked you up today, I found some of your work on Flickr and YOU yourself Sir are guilty of the same such replication. Your picture of the ''Crazy Boy'' is an exact copy of ''Child with a toy hand grenade in Central Park, N.Y.C.'' by Diane Arbus. The only difference is you put mickey mouse ears on his head and an axe in his hand. Why is it that you can replicate a work of art and that's OK, but when I use the very same artistic license i get a rude E-mail with ridiculo!

Honestly if you asked me nicely I might have considered removing the picture out of respect for a fellow artist, I probably would've wanted proof that you were the original artist or photographer. I would've thought it was silly for someone to ask me to remove it, but I probably would've removed it none the less. You, however were very pompous and aggressive in your message, so I will not be taken down the item in question. Feel free to waste your time and money trying to take action against me. If by some reason you succeed in robbing me of my right to artistic license, I will simply remove the item from my shop,then I will re-post the item after drawing some Mickey Mouse ears on her, because apparently by your standards that would make it an original. That would give me the hump too, but when you check the quality he's not up to much. Its obvious he just biting but I doubt anyone who is interested in your work is unlikely to accept one of his poor copies instead of one of yours.

If you just find a stock image and make a stencil out of it, it shouldn't all of a sudden give you sole rights to that image.

Honestly - I wouldn't worry about it - his version looks sh!te but if you've got to the stage where people are copying you then you must be doing something right.

if he had a point I would the first to admit it! the thing is that the lady who made the original photograph has copy righted the image and has also secured the photo very well.. this made me contact the original photographer and ask her for permission to use it and asked her for the image in high-res. she did agree for me to use it and she send the image to me in high-res.

so the sory about getting this image on a search engine is not likely...

also, have i added and and taken away details in my artwork from the original photo that he has used as well. this proves that he has copied my work and not the original photo.
