Whilst I appreciate there is a place for name and shame, I'd imagine any bonafide business would amicably try and sort this for you. I worked in a dealership for some time and in general if clients weren't happy a full refund was offered - assuming the piece was returned in the same condition it was sent. However I do agree that the description of mint may be a little lame based on your images - but as others have pointed out there are few truly mint Banksys these days - combination of age and the often original poor handling and framing. In summary Id give him a call and a chance to make amends prior to casting full judgement - it won't be in his interest to have an unsatisfied customer IMO...... When it is fixed I will report back. I think it's important to document this process for future customers.
Right now , I still am waiting on how he wants it sent back and will have to now wait for an unknown period of time for a refund as he doesn't have the funds.
So now I have a frame waiting for a print that was not as described that has to be returned at which point i'll have to start my search over again and be out 20 Thousand Dollars. To say i'm not happy is an understatement at this current period of time.
Maybe others have capital to sit around and wait for 20k USD, I personally hold money in an account until the buyer of a piece i sell receives it and is satisfied. I think that is common courtesy to the consumer.

Personally i'd be taking the print back in person so the gallery can't accuse the courier or delivery agent you use to send it back of damaging the print further

I'd agree with your last point - any art dealer selling high value items should have the funds to make a refund if circumstances require it. Normal practise would be a refund immediately following receipt and inspection of the item. Hope this is all a misunderstanding and you get sorted promptly....

I hadnโt noticed any blemishes at all on the front... but hey these things happen. I offered a partial refund, which was refused, so i offered a full refund. Whatโs the problem exactly? I havenโt been able to see the issues for myself yet as i donโt have the print back, but honestly i am very surprised that this has come up as i looked over the front and saw nothing wrong. If any of you experts slagging me off feel you can do a better job then me then feel free to do so. The print was only delivered to the framer today. Personally i feel itโs a bit soon to discuss in public but whatever. Obviously the purchaser will be refunded.

I received a print damaged while shipping. After complaining and sending him pictures James did nothing. Only he could complain to the shipping carrier as he was the sender. No reply on my emails. PayPal solved this problem for me. But I wasted a lot of time.
For the first time before or since one of my tubes was crushed in the post. You started a paypal claim straight away and were refunded in full via paypal almost immediately. You then kept the RTC print with minor damage for free, while i have still not received any compensation from Royal Mail. So iโm not sure how much time or money you wasted, but i feel the answer is โvery littleโ and โnoneโ. But thanks for the feedback.

I'm just glad I dodged the bullet OP unfortunately caught as I would probably have ended up in the exact same situation. Seems to be a pattern of you telling people things are mint, and only selling it if they don't ask for piccs.
Also if you see a stain, stop rubbing. Your arrogant comments only make it worse for you and your business. You fucked up, say sorry and try to do better.

I have other pieces with PFG with a completed frame for another laugh now I will have to source. I have waited a long time and was hoping to have these pieces crated and shipped next week to hang, but don't have any insight into when the refund will be made.

Advertised as MINT - CLEARLY NOT, then comes out with a schoolboy excuse of "I didn't check the back" (of a ยฃ16k) print... then doesn't have the money available for a full refund.
In the interest of balance:
Unbelievable that the buyer never asked for hi-rez detailed pics of both front and back and a video of the piece. Trying to claim the moral higher ground by saying he's a man of his word so stuck with this deal when he'd been offered it less from Banksys people when the truth if the matter is he didn't want to lose his deposit..

And then if a resolution cannot be reached, and one party feels burnt..go public and name and shame. I would argue that it's the interest of other collectors who may be in the process of dealing with said Gallery to hold off for the time being. We've had a similar theme play out on the Kremer thread with poor standards associated with another gallery.
All too ready to accept instant payment from collectors & clients.
It's about raising the standards, transparency and accountability.
The main question to me is why this is all being acted out on a public forum when it should be a private matter between the gallery and the buyer. And then if a resolution cannot be reached, and one party feels burnt..go public and name and shame. I would argue that it's the interest of other collectors who may be in the process of dealing with said Gallery to hold off for the time being. And the cash flow issues to not generate an immediate refund?! Sounds like damage has been, if people do Google searches. Those initially defending him, what do you think now? How would you feel in the shoes on these multiple instances? Hopefully all those affected get full refunds and unequivocal apologies. Perhaps inspections can be more thorough in future (or get an independent conservators report with each print).

Totally agree
1. James shouldnโt be selling poor quality prints as mint thatโs for sure. 2. The buyer had no need at all to jump straight on here about it. This is the modern world sadly.. attack attack before conversation.

How does a gallery or anyone for that matter sell something and before making sure the transaction is completed, already spends the money?
This is big money, Where Iโm from people would be looking for you if you misrepresented something in a sale and then could not refund the money instantly.
Hope it gets resolved. You have no issue with this being a public matter because a) the print was nowhere near mint and b) the offer of refund in instalments.
Hope a valuable lesson has been learned by both parties.
