They probably went onto the website and there are prints similar to the mural painted on the building for sale plus the smiley face on the door is associated to the mural so the council would view as advertising👀😮

I'm not a huge fan of RYCA either but I think this sets a dangerous precedence for street art in general. Couldn't you, in theory, say all street art is advertising if that artist's work is being sold in an art gallery?   
Is Banksy street art (and others) an advert for Sothebys contemporary art auctions?

If you take RYCA out of the equation and say put Damien Hirst in his stead (which he does sell) is it advertising and who is it advertising?

I think the angle the council is taking is the Mural promotes the gallery, which comes under "Direction" and therefore is deemed as advertising. So therefore with this argument does that not make any mural or piece of street art "advertisement" for any business near by or for that matter the artist. Many artist do a street piece then produce a print to sell.
