This is the cheapest Hirst I have ever purchased. Unfortuntaly the gallery phoned me the next morning saying their had been a fault and refunded my £15 shipping   At least for 12 hours I was the proud owner of a free Hirst reduced by £8,500.00 - I even got a confirmation of order email.

Contract Law For a contract to be valid and binding in English law, there must be an acceptance of an offer, as well as consideration (or the price). Price tags are not ‘offers’ in English contract law. When you place an order on a website, you are offering to purchase the goods, and it is then up to the company to ‘accept’ your offer to purchase the goods. This is why sometimes people place orders on websites, thinking their order has been accepted because payment has been taken, but actually there is no contract fulfilled until the company ‘accepts’ the order.
If The Company Had Accepted Your Offer If the company had dispatched the trousers and then sent you an invoice, you would not be legally obliged to send them any more money as they would have ‘accepted’ your offer to pay only the P & P for the trousers.

That would have hurt Ben's profit margin a little bit  Assume it was sold hence went to zero, but the buy button should have gone as well...

All I know is that I pressed buy and went through all the usual motions, card details etc and then received the confirmation email.

I get the idea that confirmation email, would count as an accepted order.
But at the same time, i guess you have now accepted the cancellation!

i think its probably one of those things where you probably could with allot of time and money get the hirst for £9 as xmyart says i think the confirmation would count, but would you really want to rip off the gallery like that? all a bit of fun i say... nice find tho ;D

I get the idea that confirmation email, would count as an accepted order. But at the same time, i guess you have now accepted the cancellation! It happened about 12 months ago. I didn't ever have any legal right, unless they actually sent it which wasn't ever going to happen - If you saw a Hirst or even a Banksy that was for sale for £0.00 reduced from £8000 tell me you wouldn't at least have a punt.

id be on it like a shot. that wasnt my point. I think the confirmation mail made it yours, and if youd tried you could have proved it in court if needed. But at the same time, if they mailled ad said sorry not available, and you said "yeah thats cool" then you released them from the contract.
At the same time i wouldnt want to see the gallery lose that kind of cash. However, i sell online, and have made some shocking price mistakes, but if someone buys them before i have realised the mistake, I SEND THEM!!! Basically as i see it as my mistake, not the buyers, who was just quick enough to get themselves a sh1t hot deal.
Just the way i see stuff like this. Would i have pushed to get the Hirst, dont know, but its possible.
