I paid VAT at the gallery without thinking much about it, and when I became aware that I should be due a refund, the gallery said that they would begin looking into it. That was about 2 months ago. I canโt imagine that this is the first time theyโve ever run into this issue, but they keep saying theyโre working on it. Itโs a well known gallery.
Is there anything I can do to help speed this up? Does it take this long? Shouldnโt they have not charged me in the first place and if so can I demand a refund regardless of anything might need to file on their end? Thanks.

If they sell items inclusive of VAT then they cannot simply knock off the VAT charge to foreign customers (after all, they don't know if you are exporting the item or not). You have to pay up and then reclaim the cost from HMRC later. It seems a bit unfair but I think that's how it works.

I've always found if you are taking the piece there and then from a uk gallery, they will charge you VAT. If the gallery ship it to my USA address, they can guarantee it is leaving the country.
Obviously always be cautious that you are then due to pay the import duty... for LA it is around half of the VAT.

This margin scheme to me seems a bit a scheme for the seller pocketing the VAT on an exported print, which you (buyer) should instead receive. This is because you have to pay a sales tax on your import in the US (there are no duties on prints, I believe, but taxes yes) when you declare it.
